Special and General Courts-Martial Results for September 2018

Reports of the results of Special and General Courts-Martial that convened within the United States Navy in September 2018 announced.

The following reports the results of every Special and General Courts-Martial convened within the United States Navy in September 2018. The cases are separated by the Navy Region in which they were tried.

Naval District Washington

General Court-Martial

* At a General Court-Martial in Washington, D.C., an E-6 was tried for two specifications of sexual assault of a child. On Sept. 14, 2018, the members panel returned a verdict of not guilty.

Special Courts-Martial

* At a Special Court-Martial in Washington, D.C., Petty Officer Second Class Ramone Wilson, USN, pled guilty pursuant to a pretrial agreement to larceny and mail opening. On Sept. 27, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, a fine of $5,836.95, and confinement for foru months. The pretrial agreement had no effect on his sentence.

Navy Region Mid-Atlantic

General Court-Martial

* At a General Court-Martial in Norfolk, Virginia, Cmdr. David A. Morales, USN, was tried for conspiracy to commit bribery, failing to report to his security manager his contact with a foreign national, false official statement, conduct unbecoming an officer, and bribery. On Sept. 1, 2018, the military judge returned a verdict of guilty to failing to report a foreign national to his security manager and conduct unbecoming an officer and sentenced him to forfeit $6,000 per month for 5 months, a fine of $5000, and confinement for 165 days.

* At a General Court-Martial in Norfolk, Virginia, an E-3 was tried for aggravated sexual contact and sexual harassment. On Sept. 25, 2018, the members panel returned a verdict of not guilty.

Special Court-Martial

* At a Special Court-Martial in Norfolk, Virginia, an E-3 was tried for wrongful use of a controlled substance.  On Sept. 10, 2018, the military judge returned a verdict of not guilty.

Navy Region Southeast

General Courts-Martial

* None.

Special Court-Martial

* At a Special Court-Martial in Mayport, Florida, Petty Officer Third Class Shaquel N. Hinds, USN, pled guilty pursuant to a pretrial agreement to larceny of military property of a value over $500.00. On Sept. 11, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 90 days. Pursuant to the pretrial agreement, the Bad Conduct Discharge is to be disapproved. The pretrial agreement contained a waiver of the accused’s administrative separation board.

* At a Special Court-Martial in Jacksonville, Florida, Petty Officer Third Class Carlos A. Crespo, USN, pled guilty pursuant to a pretrial agreement to assault consummated by a battery. On Sept. 13, 2018, the military judge sentenced him to forfeit $1,000 per month for four months, reduction in rank to paygrade E-1, and confinement for foru months. The Pretrial agreement had no effect on his sentence. The pretrial agreement contained a waiver of the accused’s administrative separation board.

* At a Special Court-Martial in Pensacola, Florida, Petty Officer First Class Wolff A. Guerrier, USN, pled guilty pursuant to a pretrial agreement to two specifications sexual harassment.  On Sept. 11, 2018, the military judge sentenced him to forfeit $1,500 per month for two months, reduction in rank to paygrade E-5, and confinement for 30 days. Pursuant to the pretrial agreement, all forfeitures and confinement are to be disapproved.

* At a Special Court-Martial in Jacksonville, Florida, Petty Officer First Class Steven G. Zundel, USN, pled guilty pursuant to a pretrial agreement to communicating a threat. On Sept. 25, 2018, the military judge sentenced him to reduction in rank to paygrade E-5 and confinement for 60 days. Pursuant to the pretrial agreement, all confinement in excess of 30 days will be suspended and the reduction in rank is to be disapproved. The suspended confinement may be served if the Service Member violates the terms of the pretrial agreement.

Navy Region Southwest

General Court-Martial

* At a General Court-Martial in San Diego, California, Hospitalman Nathaniel T. Huron, USN, pled guilty pursuant to a pretrial agreement to wrongful use of a controlled substance and assault consummated by a battery. On Sept. 6, 2018, the military judge sentenced him to forfeit $1,451.00 per month for one month, reduction in rank to paygrade E-1, and confinement for 25 days. The pretrial agreement had no effect on his sentence.  The pretrial agreement contained a waiver of the accused’s administrative separation board.

* At a General Court-Martial in San Diego, California, Seaman Kyle M. Ines, USN, pled guilty pursuant to a pretrial agreement to sexual assault and child pornography. On Sept. 6, 2018, the military judge sentenced him to be discharged with a Dishonorable Discharge, to forfeit all pay and allowances, reduction in rank to paygrade E-1, and confinement for six years. Pursuant to the pretrial agreement, all confinement in excess of 36 months is to be suspended. The suspended confinement may be served if the Service Member violates the terms of the pretrial agreement.

* At a General Court-Martial in San Diego, California, Petty Officer Second Class Jeremy P. Duncan, USN, pled guilty pursuant to a pretrial agreement to false official statement, committing a sexual act upon a child, and three specifications of committing a lewd act upon a child. On Sept. 27, 2018, the military judge sentenced him to be discharged with a Dishonorable Discharge, to forfeit all pays and allowances, reduction in rank to paygrade E-1, and confinement for 10 years. Pursuant to the pretrial agreement, all confinement in excess of 42 months is to be disapproved. 

Special Court-Martial

* At a Special Court-Martial in San Diego, California, an O-5 was tried for wrongful use of a controlled substance. On Sept. 11, 2018, the military judge returned a verdict of not guilty.

Navy Region Hawaii

General Court-Martial

* At a General Court-Martial in Pearl Harbor, Hawaii, Petty Officer First Class Steve Axe III, USN, was tried for one specification of attempted sexual assault of a child and two specifications of attempted sexual abuse of a child. On Sept. 13, 2018, the panel of members found him guilty of all three specifications and sentenced him to be discharged with a Dishonorable Discharge, to forfeit all pay and allowances, reduction in rank to paygrade E-1, and confinement for five years.
