At a General Court-Martial in Norfolk, Virginia, Petty Officer 2nd Class Royce P. Damian, USN, pled guilty pursuant to a pretrial agreement to three specifications of wrongful use, possession and manufacture of a controlled substance, and obstruction of justice. On July 3, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 13 months. The pretrial agreement had no effect on the sentence.
At a General Court-Martial in Norfolk, Virginia, Petty Officer 3rd Class Brian E. McCreary, USN, pled guilty pursuant to a pretrial agreement to false official statement, two specifications of larceny, and falsifying military identification. On July 20, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, a fine of $2,268.00, and confinement for 7 months. The pretrial agreement had no effect on the sentence.

At a Special Court-Martial in Norfolk, Virginia, Fireman Jacob T. Bare, USN, pled guilty pursuant to a pretrial agreement to three specifications of failure to obey an order or regulation, failing to report to muster, wearing civilian clothes while on restriction and using personal cell phone on restriction, two specifications of wrongful use and introduction of a controlled substance, and breaking restriction. On July 13, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 6 months. Pursuant to the pretrial agreement, the punitive discharge will be disapproved and all confinement greater than time served (38 days) is to be suspended. The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement. The pretrial agreement contained a waiver of the accused’s administrative separation board.
At a Special Court-Martial in Norfolk, Virginia, Fireman Recruit Aaron T. Kestler, USN, pled guilty pursuant to a pretrial agreement to two specifications of wrongful use of a controlled substance, failure to go to his place of duty, absence without leave, and breaking restriction. On July 26, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, and confinement for 8 months. Pursuant to the pretrial agreement, all confinement greater than 90 days is to be suspended. The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement.

At a Special Court-Martial in Jacksonville, Florida, Seaman Malik M. Glover, USN, pled guilty pursuant to a pretrial agreement to use of marijuana, possession of marijuana with the intent to distribute, and possession of drug paraphernalia. On July 6, 2018, the military judged sentenced him to forfeit $560 per month for 9 months, to reduction in rank to paygrade E-1, and confinement for 9 months. Pursuant to the pretrial agreement, all confinement greater than 78 days is to be suspended. The suspended confinement may be served if the Service Member violates the terms of the pretrial agreement. The pretrial agreement contained a waiver of the accused’s administrative separation board.

At a Special Court-Martial in Bremerton, Washington, Petty Officer 2nd Class Esperanza (NMN) Delgado, USN, pled guilty pursuant to a pretrial agreement to conspiracy to obstruct justice. On July 6, 2018, the military judge sentenced her to reduction in rank to paygrade E-1, and confinement for 60 days. The pretrial agreement had no effect on her sentence. The pretrial agreement contained a waiver of the accused’s administrative separation board.
At a Special Court-Martial in Bremerton, Washington, Airman Connor J. Silvis, USN, pled guilty pursuant to a pretrial agreement to failure to obey a lawful order, and to six specifications of introduction, possession and use of controlled substances. On July 12, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 9 months. The pretrial agreement had no effect on his sentence.
At a Special Court-Martial in Bremerton, Washington, Petty Officer 3rd Class John J. Thomas, USN, pled guilty pursuant to a pretrial agreement to unauthorized absence, two specifications of failure to obey a general order by having a vapor cigarette device onboard and possession of drug paraphernalia, and eight specifications of introduction and use of controlled substances. On July 12, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 8 months. Pursuant to the pretrial agreement, all confinement in excess of time served (214 days) will be suspended.
At a Special Court-Martial in Bremerton, Washington, Airman Brandon J. McCaulley, USN, pled guilty pursuant to a pretrial agreement to conspiracy to obstruct justice, willful dereliction of duty, destruction of military property through neglect, and discharging a firearm through negligence. On July 13, 2018, the military judge sentenced him to reduction in rank to paygrade E-1, and confinement for 90 days. The pretrial agreement had no effect on his sentence. The pretrial agreement contained a waiver of the accused’s administrative separation board.
At a Special Court-Martial in Bremerton, Washington, Airman Eric N. Martinez, USN, pled guilty pursuant to a pretrial agreement to making a false official statement, and introduction, use, and distribution of controlled substances. On July 19, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-1, and confinement for 10 months. Pursuant to the pretrial agreement, all confinement greater than 9 months will be suspended. The suspended confinement may be served if the Service Member violates the terms of the pretrial agreement.

At a Special Court-Martial in San Diego, California, Petty Officer 2nd Class Christopher Pierre-Louis, USN, pled guilty pursuant to a pretrial agreement to wrongful use and distribution of a controlled substance. On July 5, 2018, the military judge sentenced him to be discharged with a Bad Conduct Discharge, reduction in rank to paygrade E-3, and confinement for 150 days. Pursuant to the pretrial agreement, all confinement greater than 3 months is to be suspended. The suspended punishment may be served if the Service Member violates the terms of the pretrial agreement.

Wing, USN, pled guilty pursuant to a pretrial agreement to wrongful use and distribution of a controlled substance. Pursuant to the pretrial agreement, the punitive discharge will be disapproved and all confinement in excess of 35 days is to be suspended. At a General Court-Martial in Pearl Harbor, Hawaii, Petty Officer 3rd Class Patrick C. Delanney, USN, pled guilty pursuant to a pretrial agreement to indecent visual recording, distribution of child pornography and possession of child pornography. On July 12, 2018, the Military Judge sentenced him to be discharge with a Dishonorable Discharge, reduction in rank to paygrade E-1, and confinement for 12 years. The pretrial agreement had no effect on the adjudged sentence.
Navy Region Japan
At a General Court-Martial in Yokosuka, Japan, Chief Petty Officer Jason R. Theaux, USN, was tried for attempted sexual assault of a child and attempted sexual abuse of a child. On July 12, 2018, a panel of members returned a verdict of guilty to all specifications. The panel sentenced him to be discharged with a Dishonorable Discharge, reduction in rank to paygrade E-1, and confinement for 172 days.
At a Special Court-Martial in Yokosuka, Japan, Senior Chief Petty Officer Scott M. Severs, USN, pled guilty pursuant to a pretrial agreement to indecent language. On 16 July 2018, the military judge sentenced him to reduction in rank to paygrade E-6. The pretrial agreement had no effect on his sentence. The pretrial agreement contained a waiver of the accused’s administrative separation board and retirement grade determination.
