Five Things to Know: Sharing of Intimate Images

Here are five things you need to know about the new Article 1168 of U.S. Navy Regulations:

1) Wrongfully distributing or broadcasting an intimate image for personal gain, or with the intent to humiliate, harm, harass, intimidate, threaten, or coerce the depicted persons, or with reckless disregard as to whether the depicted person would be humiliated, harmed, intimidated, threatened, or coerced is a violation of Navy regulations.

2) An intimate image is a visual depiction of an identifiable person engaging in sexually explicit conduct or that depicts at least one of his or her private areas, and that was taken under circumstances in which the subject had a reasonable expectation of privacy.

3) Distribution means the act of delivering an image to the possession of another, including transmission by electronic means. Broadcasting means the act of electronically transmitting a visual image with the intent that it be viewed by a person or persons.

4) This regulatory change complements Article 120c of the Uniformed Code of Military Justice (UCMJ), which prohibits the indecent viewing, visual recording or broadcasting of another person.

5) Anyone found to have violated the new regulation could be subject to adverse administrative or disciplinary action, including nonjudicial punishment (NJP), court-martial and/or administrative separation.
